Minister puts statutory instrument before parliament
The Building Safety Regulator will be transferred out of the Health and Safety Executive in January.
The Ministry for Housing, Communities and Local Government (MHCLG) announced back in June 2025 that the regulator would have its functions moved away from the body and into a new executive non-departmental public body sponsored by the department.

On Tuesday (11 November), the minister for building safety, fire and democracy, Samantha Dixon, laid a statutory instrument before parliament, which will create the legal basis for the move.
Building Safety Regulator (Establishment of New Body and Transfer of Functions etc.) Regulations 2026 will come into force on 27 January 2026.
“This change will position the BSR for the coming years,” the MP for Chester North and Neston told parliament.
“It will strengthen lines of accountability and give a dedicated focus to BSR operations, and is an important first step towards establishing a single construction regulator, the lead recommendation of the Grenfell Tower Inquiry Phase 2 report.
“I am grateful to HSE for the leadership and experience it has brought to the establishment and early operations of the BSR, and for its ongoing support as this change is made.”
