Firm fined £7,500 for misusing title of 'architect'

Smart Design Group was warned several times to stop

A design firm has been fined £7,500 for misusing the title ‘architect’ on its advertising material.

Smart Design Group, run by Malcolm Capstick, pleaded guilty to three charges at North and East Devon Magistrates’ Court.

Capstick was accused of using the term ‘chartered architect’ on the website for Smart Design Group and also on promotional material that was distributed at a trade show.

He was warned not to use the wording several times, but continued to do so.

Capstick said his intention was to go into business with a chartered architect, although he hadn’t named any individual prior to the hearing date. He also said that his website designer had failed to make the requested amendments to the site.

The court awarded a total sum of £7872.24 against Capstick.
